Super Mario World's English localization was produced in May 1991 (for the game's North American release in August of that year), which was over six years after this game was released. And Gremlin's mole character was largely forgotten by then. Furthermore, by the time SMW was released in the UK (where Gremlin was located), Gremlin was on its last limbs, so it apparently didn't have the strength to file any lawsuit against Nintendo of Europe, especially given how much more notable the latter name was.

It was supposed a joke. I apologize.

I wonder if these guys sued Nintendo for naming a character Monty Mole.
