Why is the track list on the back cover different from the actual FLAC/MP3s?

It seems 3 tracks are missing here.

Tracklist and provided files are mismatched, unfortunately, 1-4 Ocarina Melody Suite, 2-2 Jingle Suite, and 2-4 Ocarina of Time Hyrule Field, are missing from this album.

If these tracks are from CD then why are they 48khz not 44.1khz?
